Terms of
Service

By using the SwanFIT website (“Service/Product”), you are agreeing to be bound by the following terms and conditions. SwanFIT reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current service, including the release of new features and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.

 

Payment, Refunds, Upgrading & Down Grading Membership Terms:

The Service is billed in advance on the term stated and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, credit balances, or refunds for months unused with an open account.
In order to treat everyone equally, no exceptions will be made.For any upgrade or downgrade in membership, your credit card or debit card that you provided will be charged a prorated amount and then automatically be charged the new rate on your next billing cycle.All fees are inclusive of GST.

Challenges:

SwanFIT challenges cannot be put on suspend, this is a set challenge. Challenges are non refundable. If you are paying for the challenge weekly, SwanFIT will take a automatic payment out of your nominated account each week. If the payment fails, EziDebit will charge a failed payment fee for this, SwanFIT cannot refund the failed payment fee as it is taken by EziDebit. Clients are responsible for making all payments throughout the challenge, if you cannot attend classes one week, you are still liable to make payment for that week. Information given out to challenge clients cannot be shared amongst people who are not exclusive to the challenge. If information is shared, you do risk being asked to leave the challenge early. SwanFIT has the right to ask anyone to leave the challenge without any refund given to the client. 

Membership Suspension:

All memberships can be placed on suspension during a membership term. Suspension periods must be for a minimum of 14 days. Each client has a maximum of 90 days per year to put their membership on hold. Any clients wishing to suspend their membership must send an email to info@swanfit.co.nz with the dates for the hold (email between Monday - Friday). Membership suspension must be approved by SwanFIT before the suspension takes place.
A confirmation email will be sent, confirming suspension request. A membership suspension cannot be back dated.

Membership Renewals & Payments:

Memberships will automatically roll over to a month to month basis once the membership term has ended. For example, if you are on a 12 month contract and your 12 months is up the membership will automatically renew for the 12 month period at $55 per week, however once you have done your first 12 months we no longer require a 25% cancellation fee of remaining costs, we only require the 30 days cancellation notice.

Membership cancellations:

Month to Month Membership
If you are on a month to month membership, we require 30 days paid written notice via email for membership cancellations.
6 Month Membership
If you are on a 6 month membership and wish to cancel, there is a cancellation fee of 25% of remaining costs owing on the membership, this must be paid as a lump sum, cancellation fees cannot be paid off.
12 Month Membership
If you are on a 12 month membership and wish to cancel, there is a cancellation fee of 25% of remaining costs owing on the membership. this must be paid as a lump sum, cancellation fees cannot be paid off.

Classes:

We require you to book in your classes 2 hours before the class start time. We allow up until 10 hours before the class starts for clients to cancel their session and re book for another available time. If you fail to cancel your session 3 hours before the class starts and do not show up this, you will be issued a warning for your first time. If you continue to have no shows then there will be a penalty of $5.75 per time for repeated sessions missed without being cancelled off the system. If you cancel your class within 3 hours of the session starting, you will be charged $5.75 for the late cancellation. If you repeatedly continue to do 'no shows' you will be banned from booking classes for the following week (membership payment will still be taken).

Injuries:

If you receive an injury during our challenge which means you cannot attend your sessions for that week, we cannot credit these missed sessions. If your injury causes you to miss training for longer than 1 week during the challenge, we require a medical certificate as proof and arrangements can be made for the missed sessions. If you receive an injury while on one of our memberships, you can choose to put your membership on hold but it must be for a minimum of 2 weeks. 

Refunds:

In the event of a request for refund on any fees paid for membership or services, the following procedures apply.The client must be advised any request for refund in writing via an email to info@swanfit.co.nzSwanFIT will then contact the client to discuss any issues the client may have to determine the reasons for the refund request. If the reason for refund is deemed to be a responsibility of SwanFIT, then the funds will be directly deposited into the clients account. SwanFIT will provide notification of the amount of the refund and an expected date the refund will be deposited to member via email.At no time are Trainers permitted to issue a refund directly.

Damaged, Lost or Stolen Property:

The Organiser is not responsible for any personal property of any individual that is damaged, lost or stolen while at the SwanFIT studio.

Response Time:

For all emails, messages, calls & posts on facebook we will get back to you within 24 hours.

Advertising & Publicity:

Sometimes we may photograph a session for use in promotional and other business related material. It is possible that, as a SwanFIT client, you may appear in a photograph. If you do not want your image to be used, it is your responsibility to advise the Organiser in writing of this.

Privacy Policy:

We collect the e-mail addresses and personal information of our clients. Member information is not shared with or sold to other organisations for commercial purposes, except to provide products or services you’ve requested, when we have your permission.
From time to time we will use images of our clients for promotion of the SwanFIT website and services.
These images are only the images that our members freely make available to us.

Data Storage:

SwanFIT uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run swanfit.co.nz.  Although SwanFIT owns the code, databases,
and all rights to the SwanFIT website and application, you retain all rights to your data.

Disclosure:

SwanFIT may disclose personally identifiable information under special circumstances,
such as to comply with subpoenas or when your actions violate the Terms of Service.

Changes:

SwanFIT may periodically update this policy. We will notify you about significant changes in the way we treat personal
information by sending a notice to the primary email address specified.

By purchasing one of our services you are confirming that you have acknowledged and you agree to the terms and conditions set out above.
